These Terms of Service govern your use of moorbuoys.com and purchases from Moorbuoys LLC, doing business as Moorbuoys Shop.

By accessing the store or placing an order, you agree to these Terms.

Eligibility

You must be legally capable of entering a binding agreement to use the store and purchase products. You may not use the store for an unlawful or unauthorized purpose.

Product information

We make reasonable efforts to describe and display products accurately. Colors, finishes, dimensions, and appearance may vary slightly because of manufacturing tolerances, lighting, screens, and photography.

Product specifications and availability may change without notice.

Intended use and safety

The Buoycatcher Max is a marine-assistance tool. Customers are responsible for:

  • Reading and following all product instructions
  • Inspecting the product before each use
  • Using the product only for its intended purpose
  • Exercising appropriate seamanship and judgment
  • Considering weather, current, vessel movement, line loads, and surrounding hazards
  • Complying with applicable boating and marina rules

The product is not a substitute for safe boating practices, proper training, required safety equipment, or the judgment of the vessel operator.

Do not use a product that appears damaged, excessively worn, modified, or unsafe.

Orders

Submitting an order is an offer to purchase. We may accept, reject, or cancel an order for reasons including:

  • Product unavailability
  • Pricing or description errors
  • Suspected fraud
  • Payment problems
  • Shipping restrictions
  • Order-quantity limitations

If we cancel an order after payment, we will refund the applicable amount.

Prices and payment

Prices are stated in U.S. dollars unless otherwise indicated. Applicable shipping charges and taxes are shown during checkout.

You agree to provide current, complete, and accurate billing and payment information.

Shipping, returns, and refunds

Intellectual property

The store’s text, photographs, graphics, logos, layout, videos, and other content are owned by us or used with permission and are protected by applicable intellectual-property laws.

You may not reproduce, distribute, modify, commercially exploit, or create derivative works from store content without prior written permission.

Reviews and submissions

When you submit a review, photograph, testimonial, comment, or other content, you represent that:

  • You have the right to submit it

  • It does not violate another person’s rights
  • It does not contain unlawful, abusive, or malicious content

You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and adapt the submission for store operations and marketing, subject to applicable law.

Limitation of liability

To the fullest extent permitted by law, Moorbuoys LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the store or product.

Our total liability arising from a purchase will not exceed the amount paid for the product giving rise to the claim, except where a greater remedy is required by law.

This limitation does not apply where liability cannot legally be limited or excluded.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Moorbuoys LLC harmless from claims arising from your unlawful use of the store, violation of these Terms, or infringement of another party’s rights.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Any dispute will be brought in the state or federal courts located in Kent County, Delaware, unless applicable consumer law provides otherwise.

Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

Changes

We may update these Terms by posting a revised version. Changes apply prospectively from the stated effective date.
